The conditions under which receivables exist usually involve some degree of uncertainty about their collectability, in which case a contingency exist.
Obligation to Repurchase Receivables Sold durationAn agreement to repurchase receivables that have been sold to a third party, which exposes the entity to collection loss.
Damages from Product Defects durationThe risk of loss arises with respect to product defects and recalls, or improperly performed services which actually or allegedly resulted in damages suffered by the injured party, excluding major product liability matters.
Insurance Claims durationA demand for payment of a policy benefit because of the occurrence of an insured event, such as the death or disability of the insured; the maturity of an endowment; the incurrence of hospital or medical bills; the destruction or damage of property and related deaths or injuries; defects in, liens on, or challenges to the title to real estate; or the occurrence of a surety loss; and the costs to process claims.
Insurance-related Assessments durationAny funding mandated by statute or regulatory authority that is related directly or indirectly to underwriting activities, including pools for self-insurance and excluding premium taxes and income taxes. The funds derived from the assessments generally enable a government guarantor to pay insurance claims in the event that the underwriting insurer is insolvent or otherwise unable to meet its payment obligations.
Uninsured Risk durationRisk arising from insurance deductibles, self-insurance, or no insurance.
Loss from Catastrophes durationRisk of loss from natural disasters and major man-made disasters, often insured by property and casualty insurers and reinsurers subject to deductibles and policy exclusions.
Unfavorable Regulatory Action durationA enacted or proposed action, ruling or regulation that is likely to or possibly will have an adverse effect on the entity's financial position or results of operations, excluding tax matters.
Threat of Expropriation of Assets durationThe risk of loss pertaining to the potential threat that a political body may take away certain assets of the company without fair, and possibly with little or no, compensation.
Damage from Fire, Explosion or Other Hazard durationRisk of loss from uninsured portions of losses resulting from fire, explosion or other hazard.
Loss on Long-Term Purchase Commitment durationEstimated loss from pricing or market conditions arising from an obligation under a purchase commitment (evidenced by an executory contract which involves both an item that might be recorded as an asset and an item that might be recorded as a liability) with terms longer than one year or the normal operating cycle, if longer.
Withdrawal from Multiemployer Defined Benefit Plan durationObligation(s) resulting from employer withdrawal from a multiemployer 1) pension plan under circumstances that would give rise to an obligation or (b) other postretirement benefit plan under circumstances that would give rise to an obligation or an increase in the contribution to the fund during the remainder of the contract period to make up a shortfall necessary to fund the vested and negotiated benefits.
Unasserted Claim durationA claim for damages that is likely to be made and for which it is reasonably possible that there will be an unfavorable outcome, such as a likelihood that lawsuits from parties as yet unidentified will be filed alleging injury from using a product when other parties have successfully sued the entity for such use.
Guarantee Obligations durationA written or oral contract that obligates the guarantor to either pay cash or perform services if another party fails to perform specified actions or achieve specified results.
Financial Standby Letter of Credit durationAn irrevocable undertaking (typically by a financial institution) to guarantee payment of a specified financial obligation if defined events occur or fail to occur.
Fair Value Guarantee durationGuarantee of fair value of financial or nonfinancial asset owned by the guaranteed party.
Property Lease Guarantee durationA guarantee of performance by a third party lessee under terms of a lease agreement.
Stock Market Price Guarantee durationA guarantee of the market price of the common stock of the guaranteed party.
Guarantee of Scheduled Contractual Cash Flows from Assets of Transferee durationThe guarantee of the collection of the scheduled contractual cash flows from individual financial assets held by a transferee.
Guarantee of Business Revenue durationContracts that contingently require the indemnifying party (guarantor) to make payments to the indemnified party (guaranteed party) the amount by which the revenue of a specified business (or a specific portion of a business or for a specified product) for a specified period of time is less than a specified amount.
Performance Guarantee durationAn agreement (contract) that requires the guarantor to make payments to a guaranteed party based on another entity's failure to perform under an obligating agreement. This may include the issuance of a performance standby letter of credit which requires the guarantor to make payments if a specified party fails to perform under a nonfinancial contractual obligation.
Guarantee of Indebtedness of Others durationAgreements (contracts) that contingently require the guarantor to make payments of principal and interest to a lender on another party's debt if that party fails to comply with the terms of the borrowing arrangement.
Standby Letters of Credit durationAn irrevocable undertaking (typically by a financial institution) to guarantee payment of a specified financial obligation.
Indemnification Agreement durationAn agreement (contract) that contingently requires the guarantor to make payments to the guaranteed party in compensation for that party's or parties' loss or injury attributable to specified events or actions, such as a patent infringement action against an entity that relied on certain representations as to ownership rights made by a software vendor.
Indirect Guarantee of Indebtedness durationAn indirect guarantee of the indebtedness of another party arises under an agreement that obligates one entity to transfer funds to a second entity upon the occurrence of specified events, under conditions whereby (a) the funds become legally available to creditors of the second entity and (b) those creditors may enforce the second entity's claims against the first entity under the agreement. Examples of indirect guarantees include agreements to advance funds if a second entity's net income, coverage of fixed charges, or working capital falls below a specified minimum.
Surety Bond durationAn obligation arising from a three-party agreement that legally binds together a principal who needs the bond, an obligee who requires the bond and a surety company that sells the bond.
